Seminar on the role of environmental public interest litigation in fighting China’s pollution problems

The China Programme welcomes you to a seminar with Kathinka Fürst, Research Fellow at the Netherlands China Law Centre, University of Amsterdam, on the role of environmental public interest litigation in fighting China’s pollution problems.

In April 2014, the Standing Committee of the National People’s Congress (NPC), China’s top legislature, approved major amendments to the country’s Environmental Protection Law (EPL), the first since the law was enacted 25 years ago. The new amendments to China’s bedrock EPL put powerful new tools into the hands of environmental officials and the public, providing a strong legal foundation to the “war on pollution” declared by the political leadership earlier this year. Amongst the amendments are new rules widening the standing requirements for NGOs to take legal action against polluters on behalf of the public interest.

In January 2015 when the new EPL is enacted NGOs registered with city-level or higher governments in China, with five years of experience in environmental matters and in good standing, will have the right to bring public interest litigation against polluting enterprises.  It is estimated that around 300 NGOs in China will meet these requirements.

But how equipped are these organizations to play a role in defending the environment through public interest litigation? And how can public interest litigation initiated by NGOs play a role in regulating China’s pollution problems? These are some of the issues that Kathinka Fürst will discuss in her presentation.
